INVITATION FOR BIDS

 

SEALED BID AUCTION FOR SALE OF REAL ESTATE


Atchison County is conducting a Sealed Bid Auction for the sale of the real estate described herein. The sale will be conducted in accordance with Atchison County Resolution 2014-1400 concerning the Disposal of Surplus Property.

The property consists of an irregularly shaped parcel of real estate located east of Sherman Road in Atchison County, Kansas. The parcel contains approximately 2.6 acres.

Part of the property is located within the floodplain, and may not be suitable for building.

Legal Description: The North Fifty feet (N50') of Lots Six (6) and Seven (7), in Block Sixty- four (64), Old Atchison

The property has not been surveyed by the County. Additional information concerning the property is attached.


BID FORM: Each prospective bidder is required to complete and execute the BID FORM attached in this Invitation for Bids, and all information and certifications called for thereon must be furnished. The executed BID FORM shall be placed in a sealed envelope containing the sealed bid and shall be marked SEALED BID AUCTION FOR SALE OF REAL ESTATE. Bids shall be filled out legibly with all erasures, strikeovers, and corrections initialed by the person signing the bid and the bid must be manually signed. Negligence on the part of the bidder in preparing the bid confers no right for withdrawal or modification of the bid.

 

DELIVERY OF BID: Sealed bid envelopes must be received by the Atchison County Clerk, Michelle Phillips in her office at the Atchison County Courthouse, 423 North 5th Street, Atchison, Kansas, or placed in the drop box labelled “Atchison County Courthouse Drop Box” on the North side (Parallel Street entrance) of the Atchison County Courthouse before 5:00 p.m. local time, on June 6, 2022.

 

OPENING OF BIDS: Bids will be opened and publicly read at the meeting of the Board of County Commissioners scheduled for June 7, 2022, at 1:00 o’clock p.m. The meeting will be held at the Atchison County Commission meeting room in the basement of the Atchison County Courthouse 423 North 5th Street, Atchison, KS 66002.

 

REJECTION OF BIDS: Atchison County reserves the right to reject any and all bids. Bids which fail to furnish all information or certifications required may be summarily rejected. Atchison County may, at its election, waive any minor informality or irregularity in bids received.

 

EVIDENCE OF TITLE: Bidders are encouraged to research, at the bidder’s sole cost and expense, the chain of title to the property. Atchison County will not be obligated to pay for any expense incurred in connection with title matters or survey of the property.

 

TITLE INSURANCE: Atchison County will make available to the successful bidder not less than five (5) days prior to the closing of this Contract, at County’s expense, a standard owner’s preliminary title insurance report, and after closing a standard owner’s title insurance policy which will insure the purchaser against loss or damage to the extent of the total purchase price by reason of defects in the title to said real estate, subject to exceptions noted in the standard owner’s preliminary title insurance report.

 

WARRANTY AS TO TITLE: If a bid for the purchase of the property is accepted, the Seller’s interest will be conveyed by a GENERAL WARRANTY DEED, and shall be subject to easements, restrictions and special assessments of record, if any, and further subject to encroachments and other similar matters that would be disclosed by survey.

 

PROPERTY INSPECTION: Prospective Bidders are invited, urged, and cautioned to inspect the property to be sold prior to submitting a bid. Prospective Bidders are granted permission to enter upon the property, at their own risk, for inspection during daylight hours.   No notice to the County is required before a Prospective Bidder inspects the property. Prospective Bidders are cautioned not to enter upon any neighboring property without permission from the owner(s) of such property. The failure of any bidder to inspect, or to be fully informed as to the condition of all or any portion of the property offered, will not constitute grounds for any claim or demand for adjustment or withdrawal of a bid after the bid opening or auction. Any bidder may, at bidder's sole expense, obtain a survey of the property prior to submitted a bid.

 

CONDITION OF PROPERTY: The property is offered for sale and will be sold “As Is” and “Where Is” without representation, warranty, or guaranty as to quantity, quality, character, condition, size, or kind. The Board of County Commissioners makes no warranty or guarantee as to the suitability of the real property proposed for sale for the intended use of any bidder. Therefore, each bidder covenants and agrees that each bidder, at the bidder’s own expense, shall examine the real property in order to determine such suitability, including but not limited to:

  1. Soils data and geology, drainage, hydrology and topographical features that would affect any present or future intended use;
  2. The presence or absence of any contamination by any hazardous substance and the expense of any required or necessary remediation (Any such required or necessary remediation shall be solely the responsibility of and at the expense of the successful bidder.);
  3. The quality and quantity of water available by any on-site water wells, and the availability of a permit or permits therefore;
  4. The nature, extent, and cost of public utilities needed to serve all or a portion of such real property;
  5. The extent and cost of compliance with subdivision regulations and other applicable rules and regulations involving public improvements, private improvements, access, building setbacks, public dedications, platting and replatting requirements of such real property.

 

TAXES: The real property proposed for sale is currently used exclusively for government purposes and as such it is exempt from ad valorem taxation. Each bidder covenants and agrees that each bidder will determine the impact of ad valorem taxation on the existing real property as well as on the intended future use of such real property. The real property proposed for sale will become subject to ad valorem taxation on the date of the deed. It will be the buyer responsibility to apply for and prosecute any application for exemption after the sale. Atchison County makes no guarantee that any bidder’s proposed use of the property qualifies for (or does not qualify for) ad valorem property tax exemption. The purchaser will be responsible for all ad valorem real estate taxes coming due after the date of sale. There will be no proration of taxes.

 

TENDER OF PAYMENT AND DELIVERY OF DEED: Within fourteen (14) days of acceptance of a Bid by the County, the successful bidder shall tender to Atchison County the purchase price in cash or certified funds. Upon such tender being made by the successful bidder, the Seller, after recordation, shall deliver to the successful bidder the GENERAL WARRANTY DEED to the property. Atchison County reserves the right to extend the closing date for a reasonable amount of time for purposes of preparing necessary conveyance documents. Time is of the essence in the interpretation and enforcement of these conditions.

 

BID INFORMATION: All bids and all information accompanying the bid become the property of Atchison County and will not be returned. As a governmental entity, Atchison County is subject to the Kansas Open Records Act. Bidder understands that bids and all materials submitted therewith may be disclosed upon proper request, after an award is made to the successful bidder.
